Sales, Return, and Warranty Terms and Conditions

Van der Geest Optiek (“we,”“us,” “our”) is the owner of the website www.vandergeestoptiek.com (the“Website”) and operates the optical store located at Generaal Cronjéstraat 86, 2021 JL, Haarlem (the“Store”). These Sales, Return, and Warranty Terms describe when you can exchange or return a product to us, when you are entitled to a refund, what warranty applies, and how we handle custom orders and deposits. We are committed to providing fair and transparent service to our customers and visitors (“you,” “your,” “yours,” “you,” “your”).

By making a purchase or placing an order with Van der Geest Optiek, you accept and agree to these terms and conditions. These terms and conditions should be read in conjunction with ourPrivacy Policy. All agreements with Van der Geest Optiek are governed exclusively by Dutch law.

1. Applicability

1.1Theseterms and conditions apply to all purchases, orders, and requests placed with Van der Geest Optiek, both in-store and—once available—through our online store.

1.2Theseller and data controller is Van der Geest Optiek, located at Generaal Cronjéstraat 86, 2021 JL, Haarlem, registered with the Chamber of Commerce in the Netherlands under number 34070312.

2. Formation of the Agreement and Down Payment

2.1Acontract is formed as soon as you place an order or give us an instruction—for example, by entering an order on the workshop order form—and we accept it. No signature or other written form is required for the contract to be valid; an offer and acceptance are sufficient (in accordance with Article 6:217 of the Civil Code).

2.2Forcustom orders, we generally require a deposit. By making the deposit, you confirm your order and agree to these terms and conditions. The deposit is legally valid and binding and serves as proof of the agreement entered into between you and us.

2.3 If you cancel your order after we have begun fulfilling it or placing the order with our supplier, the deposit serves as confirmation of the order and will not be refunded. The deposit constitutes partial compensation for the costs we have already incurred; these costs may exceed the amount of the deposit. For custom products, as described in Article 4, the remaining purchase amount may also remain due.

2.4 Upon your request, we will provide a proof of purchase or a copy of your order, which states the total amount of your purchase. This proof does not include a breakdown of purchase or cost prices or a breakdown by item; such business data is not shared.

3. Cooling-off period and right of withdrawal

3.1Purchasesin the Store: When you make a purchase or place an order in our physical Store, you have no statutory cooling-off period or right of withdrawal under the law. A purchase in the Store is final immediately. Any exchange or refund will be granted solely on the basis of Article 5 (goodwill) or Article 6 (warranty).

3.2 DistanceSales(OnlineStore): This section takes effect as soon as Van der Geest Optiek offers products via an online store or otherwise through distance sales.In the case ofa distance sale, you generally have a statutory cooling-off period of fourteen (14) days, during which you may cancel the contract without giving any reason. However, this right of withdrawaldoes not applytothe custom-made products mentioned in Article 4, nor to products sealed for hygienic reasons (such as contact lenses) whose seal has been broken after delivery (in accordance with Article 6:230p of the Civil Code). We will explicitly inform you of this before the agreement is concluded.

4. Custom-made products and products manufactured to order

4.1Wecustom-cut all lenses. Prescription lenses, as well as frames assembled with lenses according to your specifications, are manufactured specifically for you. These products cannot be returned, exchanged, or refunded: they cannot be returned to the supplier and are not suitable for other customers.

4.2 If youcancela custom order after production has begun or the order has been placed with the supplier, you remain liable for the full purchase price, including any remaining balance in addition to the deposit.

4.3Anychanges to your prescription, prescription strength, preferences, or selections made after the order has been placed will be at your expense.

4.4Theprovisions of this Article do not affect your rights in the event of a defect attributable to us or our supplier. We will remedy any delivery that is performed incorrectly or does not comply with the agreement free of charge, as described in Article 6.

5. Non-custom products and exchanges as a gesture of goodwill

5.1Fornon-personalized, unused items that are in their original, undamaged, and complete condition and are accompanied by a proof of purchase, we may—at our discretion and as a gesture of goodwill—offer an exchange or a store credit within fourteen (14) days of purchase. This is a service provided by Van der Geest Optiek and does not constitute a legal right.

5.2 The following are excludedfromexchanges made as a gesture of goodwill in any case:

(a) custom-madeproductsand products manufactured to order, as described in Article 4;

b)gift cards;

(c)forhygiene reasons, sealed products, such as contact lenses, contact lens solution, and eye drops, whose seals have been broken or that have been used;

d)itemsthat are not in their original condition, are damaged, or are missing parts for reasons not attributable to us.

5.3 We assess on a case-by-case basiswhethera product qualifies for a goodwill gesture. We reserve the right to refuse a request for an exchange or refund if the conditions listed above are not met.

6. Warranty and Defects

6.1Youare entitled to a product that is in good condition and conforms to the terms of the agreement (in accordance with Article 7:17 of the Civil Code). If a product develops a defect within a reasonable period of time that is not the result of improper use or normal wear and tear, we will repair it free of charge or, if repair is not possible, replace it.

6.2 We cannot and do not wish to excludethisstatutory right. It is separate from the leniency provision in Article 5.

6.3 The warrantydoes notcover: normal wear and tear, scratches and damage resulting from use, damage caused by drops, improper use, or insufficient maintenance, as well as the consequences of modifications or repairs not performed by us.

6.4 Many frames and lenses are also coveredbythe supplier’s manufacturer’s warranty. We are happy to assist you in making a claim under this warranty.

7. Adjustment and follow-up care

7.1Adjustingand fitting your frames is part of our service, and we generally do this free of charge.

7.2Whenyou purchase multifocal lenses, we will assist you during the adjustment period. In the unlikely event that you are unable to adjust to them, we will work with you to find a suitable solution in accordance with our terms and conditions. Please note that this is a service and does not constitute a legal right to a refund.

8. Refunds

8.1Ifa refund is applicable, we will process it using the same payment method used for the purchase, unless otherwise agreed, within fourteen (14) days after we have approved the refund.

8.2Depositswill be refunded only if the agreement is legally terminated for a reason attributable to us.

8.3Anyshipping, administrative, or handling fees are non-refundable.

9. Data Retention

9.1 We processthepersonal data we collect in connection with a purchase, order, or return—including your purchase history, information about eyeglass prescriptions, invoices, and deposits—in strict accordance with ourPrivacy Policy.

9.2 We retaininvoicesand proof of payment for at least seven (7) years to comply with the statutory tax retention requirement.

10. Revisions to these Terms and Conditions

Please note that these Terms and Conditions of Sale, Return, and Warranty may be revised from time to time. Any revised version will be published on our Website, where the most current version is available at all times. We recommend that you check our Website and these terms regularly. Changes do not apply to agreements that were already in place when the previous terms were in effect. The last revision took place in June 2026 in Haarlem, the Netherlands.
